It appears that there are some adequate consequences under HIPAA for violations, but will violators actually get caught? I have an autoimmune disease (Arthritis) that have skyrocketed my life insurance premiums. Assuming I died tomorrow and I did not disclose this fact to receive a lower premium, would it not be in the insurance companies best financial interest to violate HIPPA, pay the fine, and avoid paying out the policy?
When a professional basketball player earns a technical foul and pays a pittance in fines compared to his salary, is the fine dissuading him from inappropriate behavior in the future? Will insurance companies use the technology available to break the HIPAA law and pay a small penalty as a cost of doing business? Maybe I just don't understand the law.
